To the extent that our representatives or we ourselves provide market commentary or any other information, such commentary is for informational purposes only and should not be construed as financial or investment advice.

Any decision you make to use the Services and engage in transactions involving Digital Assets is an independent and personal decision. You acknowledge that you are not relying on any communication (oral or written) from Nexa Level X as investment advice or a recommendation.

The Platform shall not be liable for any losses incurred by you or third parties. By engaging in any transaction, you accept the risks associated with trading Digital Assets and acknowledge that you are solely responsible for evaluating such risks and ensuring you have sufficient experience and knowledge to trade.

Volatility and Risk in Digital Assets

Trading Digital Assets can be extremely volatile and involves high risks. Digital Assets may have unique characteristics that make them more or less prone to fluctuations in value. Factors beyond the Platform’s control — such as regulatory actions or extreme volatility — may affect market liquidity.

Blockchain networks may become inoperative due to errors, forks, or other unforeseen causes. You should not engage in active trading if you have limited experience or a low risk tolerance.

Speculation in the value of Digital Assets carries a high level of risk, and you should never invest more than you can afford to lose. Understanding Digital Assets requires advanced technical knowledge. Nexa Level X does not guarantee the suitability of any Digital Asset and assumes no fiduciary duty regarding your use of the Services.

Transactions involving Digital Assets may be irreversible. If you send Digital Assets to an incorrect or unverified address, you may permanently lose access to them.

Supply and Value of Digital Assets

The value of Digital Assets depends on the continued willingness of market participants to exchange them for fiat currency or other assets. This may result in a total and permanent loss of value if the market for such Digital Asset disappears. You acknowledge that certain Assets or Services may not be available in all jurisdictions.

Complex Products

Trading complex products, including but not limited to Futures and Options Contracts, may not be suitable for all users. Such trading is intended only for experienced traders who fully understand the risks associated with leverage, margin, short selling, and volatility.

You should act with extreme caution and only participate if you understand how these products work. Failure to meet margin requirements may result in the liquidation of your position at a loss and even the total loss of the assets in your account.

Nexa Level X and its affiliates assume no liability for losses or damages arising from the use of complex product services or from a lack of understanding of the associated risks.

Blocked Addresses and Confiscated Assets

Nexa Level X reserves the right to “block” certain addresses and freeze associated assets, either temporarily or permanently, if it determines — at its sole discretion — that they are linked to illegal activities or violations of the Terms.

If you send or receive assets from a blocked address, the Platform may freeze such assets and close your account. In certain cases, Nexa Level X may report the suspicious activity to the relevant authorities, and you may lose all rights to your assets.

Third-Party Dependency

The use of the Services may depend on actions or obligations performed by third parties. Nexa Level X is not responsible for the acts or omissions of such third parties.

Digital Asset Distributions

Some Digital Assets allow for distributions such as forks, staking rewards, or airdrops. Nexa Level X is not obligated to support such distributions. By holding these assets in your account, you waive any claim to rewards or distributions.

Participation in staking processes may expose your assets to additional risks. Nexa Level X is not responsible for any losses arising from such participation.

Liquidity Risk

Digital token markets may become illiquid, meaning there may be a lack of participants willing to trade. These markets can experience high volatility and make it difficult to close positions without incurring significant losses.

There is no guarantee that markets for any digital token will remain active or liquid.

Market Risk in Derivative Products

Derivative products are relatively new instruments with limited historical performance. They may be affected by sudden and adverse market changes, making it difficult to hedge against losses. Under certain market conditions, even stop-loss orders may not execute as intended.

Nexa Level X does not guarantee the continuous availability or price correlation between derivative products and their underlying assets. Any derivative product may be removed from trading without prior notice.

Technological and Cyber Risks

Software Protocols and Operational Challenges

The software protocols that underpin Digital Assets are typically open-source projects or are otherwise managed by third parties. This means that:
(i) the operation, functionality, development, and control of such Digital Assets and their underlying networks are outside the Platform’s control; and
(ii) such protocols may be subject to sudden and significant changes that can materially affect the availability, usability, or value of a given Digital Asset.

You acknowledge and accept the risk of operational challenges that may impact the Services. Nexa Level X may experience sophisticated cyberattacks, unexpected surges in activity, or other operational or technical difficulties that may cause interruptions to the Services. You understand that operational issues may occur that result in transaction or order execution delays.

You accept the risk of transaction failures arising from unforeseen or severe technical difficulties, including those caused by advanced attacks, and agree not to hold the Platform liable for any resulting losses.

The technology underlying Digital Assets may change at any time, and such changes may affect the assets stored on the Platform. You are solely responsible for monitoring such technological developments and understanding their consequences for your Digital Assets.

Users conduct all transactions at their own risk, and Nexa Level X assumes no responsibility for any loss or damage resulting from the use of the Services or from the user’s failure to understand the risks associated with the use of Digital Assets.

Digital Assets rely on the availability and reliability of power, connectivity, and hardware. Any interruption or failure in these components may disrupt the networks on which Digital Assets depend or affect your ability to access or transact in them.

Risks Related to Platform Maintenance and Downtime

Nexa Level X may, from time to time, perform maintenance on the Trading Platform, whether routine or otherwise.
During such periods, downtime and temporary lack of access to the Platform may occur, potentially resulting in delays or cancellations of submitted and unprocessed orders, as well as the inability to place new orders or modify existing ones while maintenance is in progress.

Regulatory, Legal, and Oversight Risks

Regulatory Compliance

You are responsible for complying with all applicable laws.
You acknowledge that the Platform is not responsible for determining whether or which laws or regulations apply to your transactions, including but not limited to tax laws and regulations.

You are solely responsible for reporting and paying any taxes arising from your use of the Services. Nexa Level X does not provide tax, legal, or accounting advice.

Regulatory Changes

Legislative and regulatory changes or actions at the national or international level may adversely affect the use, transfer, ability to trade, and value of Digital Assets, as well as your access to, or our ability to provide, the Services.

You acknowledge and accept these risks and understand that Nexa Level X will not be liable for any adverse effects such changes may have on your operations or investments.

Conflict of Interest

Nexa Level X charges fees for transactions and therefore benefits from trading activity (sometimes referred to as “trading volume”) regardless of whether trading is profitable for you.

The Platform and its Affiliates may have actual or potential conflicts of interest related to decisions to list or delist a particular Digital Token, or to expand or limit the scope of Services made available for that Token.

Nexa Level X Associates may trade on their own account or on behalf of others in the peer-to-peer market and may use other Services independently. Such offers and trades are not distinguished from other market activity, and Nexa Level X may act as a counterparty to any trade executed by you without your knowledge.

Nexa Level X has no duty to act on your behalf and assumes no responsibility to do so.

Legal Risks

The legality of Digital Tokens — their possession, trading, leveraging, or engaging in such activities on behalf of others — may vary by jurisdiction and is not always clear.

This means that the legality of holding or exchanging Digital Tokens, participating in related leveraged transactions, or conducting such activities for others may differ from one country to another.

Likewise, the legal classification of a Digital Token as property, an asset, or a right may vary among jurisdictions, as may the legality of offering or using leveraged services.

You are responsible for knowing and understanding how the laws applicable to you, your assets, or your rights regulate, limit, or tax the Digital Tokens you trade, the leverage you provide, or the transactions you conduct in any delegated sub-account.

Compliance with Applicable Laws

It is the Users’ responsibility to comply with local laws governing the lawful use of the Platform’s Services within their jurisdiction, as well as with any other applicable laws and regulations.

Users must also take into account, within the scope of their local laws, all tax-related obligations regarding withholding, collection, reporting, and payment of taxes to the appropriate authorities.

ALL USERS OF NEXA LEVEL X SERVICES DECLARE AND ACKNOWLEDGE that their funds originate from legitimate sources and are not derived from illegal activities.
Furthermore, Users agree that the Platform may request or collect any necessary information and documentation, in accordance with relevant laws or government orders, to verify the legality of the origin and use of their funds.

Nexa Level X maintains a policy of full cooperation with law enforcement and judicial authorities worldwide and will not hesitate to block, freeze, or close user accounts and funds that are under investigation or subject to legal orders.

Other Risks

Digital Assets available on the Platform may not be issued by Nexa Level X, financial institutions, or other legal entities.
The Digital Asset market is new, uncertain, and may not develop as expected.
Digital Assets are highly speculative and not as established as other traditional asset classes.
They are volatile and traded continuously, without limits on price fluctuations.
Trading Digital Assets may result in partial or total loss of your capital.
Actions by third parties — such as market makers or governments — may have a significant impact on Digital Assets.
Trading Digital Assets is not suitable for most individuals.
Although Nexa Level X strives to comply with all applicable laws and regulations, it may not be regulated in every jurisdiction in which it operates.
There may be other unpredictable or derivative risks beyond those mentioned above.
